Subject of the Disclosure

Disclosure on the decision and order dated 8 April 2022 (received by BRHI on 9 April 2022) of the New York Court which granted Bloomberry Resorts and Hotels, Inc.'s (BRHI) motion to dismiss the complaint filed by Bangladesh Bank as against BRHI for lack of jurisdiction.

Background/Description of the Disclosure

Further to its disclosures to the Philippine Stock Exchange dated 23 September 2020 and 29 May 2020 relating to the suit filed by Bangladesh Bank, Bloomberry Resorts Corporation (BLOOM) hereby discloses that in a decision and order dated 8 April 2022 (received by BRHI on 9 April 2022) the New York Court granted BRHI's motion to dismiss the complaint filed by Bangladesh Bank as against BRHI for lack of jurisdiction. The relevant dispositive portion states:

"ORDERED that the defendant Bloomberry Resorts and Hotels, Inc.'s (d/b/a Solaire Resort & Casino) motion to dismiss the complaint (motion sequence no. 002) is granted, and the complaint is dismissed in its entirety as against the defendant, with costs and disbursements to defendant Bloomberry Resorts and Hotels, Inc. d/b/a Solaire Resort & Casino as taxed by the Clerk of the Court, and the Clerk is directed to enter judgment accordingly in favor of defendant Bloomberry Resorts and Hotels, Inc. d/b/a Solaire Resort & Casino; x x x"
